Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant contends that he was unfairly dismissed. He applied for Parental Leave benefit from the Department of Social Protection and was advised by them that he was no longer employed.
Summary of Complainant’s Case:
The Complainant did not attend the hearing convened to hear evidence in relation to his complaint.
Summary of Respondent’s Case:
The Respondent was not required to state the response as the Complainant was not in attendance at the hearing convened to hear his complaint.
Findings and Conclusions:
The Complainant was notified of the time, date and venue for the hearing and he did not attend or provide an explanation for his absence. In the circumstances I find the complaint to be not pursued by him and not well founded.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I have decided for the reason cited, that the complaint is not well founded.
