Procedure:
In accordance with section 79 of the Employment Equality Acts 1998 – 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint gave the parties an opportunity to be heard and to present any evidence relevant to the complaint.
The Complainant submitted Form ES1 to the Workplace Relations Commission (WRC) on 18 February 2020. The Complainant was advised by the WRC on 20 February 2020 and 25 August 2020 of the process to be followed to present a complaint to the WRC under the Employment Equality Acts 1998 –2015. On 6 March 2023, the WRC wrote to the Complainant stating that it had not received a response to its letters of 20 February 2020 and 25 August 2020, and that in accordance with section 48 of the Workplace Relations Act 2015, the Director General may decide to strike out the complaint for non-pursuance. The Complainant submitted an incomplete complaint form on 18 May 2023. On 7 June 2023 and 18 August 2023 the WRC sought further information to enable it to process the complaint. On 11 December 2023, the WRC sought further information in relation to the complaint.
A written submission on behalf of the Respondent was received by the WRC on 16 January 2024. The WRC sent a copy of this submission to the Complainant. The Respondent’s submission disputed the Complainant’s claim under the Employment Equality Acts 1998-2015.
The complaint was scheduled for adjudication on 6 February 2024 at the hearing rooms of the WRC Office in Carlow. The Complainant did not attend this hearing. The Respondent was in attendance to meet the case. I verified that the Complainant had been served with notice of the time, date, and venue of the adjudication hearing. I waited some time to accommodate a late arrival. There was no appearance by the Complainant. The Complainant did not contact the WRC to indicate any difficulty with attending the hearing either before or after the hearing.

Findings and Conclusions:
As the Complainant did not attend the hearing and did not give evidence to substantiate the complaint, I find this complaint under the Employment Equality Acts 1998 - 2015 is not well-founded. |
Decision:
Section 79 of the Employment Equality Acts 1998 – 2015 requires that I decide in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Acts.
