Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The dispute at the hearing centred on the delay by management in first facilitating and then processing a claim by the worker for upgrading under a national job evaluation scheme. Following discussion with and between the parties, terms were agreed on the basis that they would be set out in a recommendation which I have done in the recommendation section of the text below.

Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
Following discussions between the parties and with the Adjudication Officer the following terms form the basis of a settlement of this dispute on an agreed basis and which are now issued by way of a formal recommendation:
- Saolta Group will pay the worker €8000 compensation for the extensive delays on the management side in facilitating and signing off on the job evaluation documentation.
- The worker will move to the first LSI on her current scale with effect from 12 January 2024. She will advance to the second LSI in the normal way on 12 January 2027.
- Terms 1 and 2 are to be accepted in writing by or on behalf of the worker within two weeks of the date of issue of this recommendation and to be implemented on receipt of that acceptance as soon as possible thereafter.
- Acceptance by the worker is to be confirmed as full and final settlement of the dispute referred to the WRC.
- In the event that the terms of this recommendation are not accepted, either party to the dispute may appeal the recommendation to the Labour Court.
