Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
A hearing was scheduled to hear the above complaints and the Complainant failed to attend. |
Summary of Complainant’s Case:
No case was made out as Complainant failed to attend at the hearing. |
Summary of Respondent’s Case:
The Respondent was in attendance and ready to rebut the allegations being made against them. |
Findings and Conclusions:
The Complainant failed to attend and I am satisfied that he was properly notified of the date, time and place of the hearing. In these circumstances I must dismiss all complaint for failing to attend. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complainant failed to attend the hearing and I determine that the following complaints are not well founded: CA-00060850-001 Section 12 of the Minimum Notice & Terms of Employment Act, 1973 the complaint is not well founded. CA-00060850-002 section 27 of the Organisation of Working Time Act, 1997 the complaint is not well founded. CA-00060850-003 section 7 of the Terms of Employment (Information) Act, 1994 the complaint is not well founded. CA-00060850-004 under Section 14 of the Protection of Employees (Fixed-Term Work) Act, 2003 the complaint is not well founded. |
