Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
A complaint was received by the Director General of the Workplace Relations commission from the Complainant on 2 February 2024 alleging that the Respondent contravened the provisions of the Payment of Wages Act, 1991 in relation to her. The WRC issued a receipt to the Complainant on 9 February 2024 using the address provided on the complaint referral form. This document was returned to the WRC by An Post on 8 May 2024 as undelivered due to “insufficient address”. The Complainant has not provided an email address on her complaint referral form. On 10 May 2024, a WRC staff member made two unsuccessful attempts to phone the Complainant using the phone number she had provided on her complaint referral form. The hearing letters were issued to the parties on 24 May 2024. In the absence of any alternative means of contacting her, the Complainant’s hearing letter was issued to her at the address provided on her complaint referral form. |
Summary of Complainant’s Case:
There was no appearance by the Complainant at the adjudication hearing. |
Summary of Respondent’s Case:
The adjudication hearing was attended by two HR Generalists from the Respondent organisation. In circumstances where the Complainant did not attend the hearing there was no requirement for evidence to be presented by the Respondent’s representatives. |
Findings and Conclusions:
The complaint was referred to me for investigation. A hearing for that purpose was held on 1 July 2024. There was no appearance by the Complainant at the hearing. As detailed above, the contact information provided by the Complainant on her complaint referral form was insufficient. In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that this complaint is not well founded, and I decide accordingly. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I declare that this complaint is not well founded. |
