Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint.
Background:
The complainant referred a complaint of constructive dismissal to the Workplace Relations Commission (WRC). This was received on 1st May 2024. The respondent representatives attended the hearing to answer the complaint. I delayed the commencement of the hearing for fifteen minutes as the complainant was not in attendance. The complainant did not attend the hearing. |

The complainant did not attend the hearing to give evidence on her complaint. |
Summary of Respondent’s Case:
The respondent representatives, Mr Donohoe, Director of the Company and Ms Boland, Director of Small Animal Veterinary, attended the hearing to answer the complaint. |
Findings and Conclusions:
I am satisfied that the complainant was on notice of the hearing and failed to attend. As the complainant failed to present any evidence, there is no evidence that the respondent was in breach of the Unfair Dismissals Act. I find the complainant was not unfairly dismissed and the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I find the complainant was not unfairly dismissed and the complaint is not well founded. |
