Procedure:
In accordance with Section 41 of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant’s employment was terminated on April 4th, 2024, and despite several emails to the company requesting one month’s notice notification or payment in lieu he was toldbythecompanyrepresentative that he was not eligible for the payment. |
Summary of Respondent’s Case:
The respondent submitted written evidence of having paid the notice payment on May 28th, 2024. He says there are other payments also due to him. |
Findings and Conclusions:
The respondent demonstrated in evidence that the payment on which the complaint had been based was paid and the complainant accepted this.
Accordingly, no payments are outstanding and the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reason set out above, complaint CA-00063340-001 is not well founded. |
