Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. No. 359/2020 which designates the WRC as a body empowered to hold remote hearings. |
Summary of Complainant’s Case:
The complainant submitted that he did not receive a written statement of the terms and conditions of his employment. |
Summary of Respondent’s Case:
At the start of the hearing, the respondent accepted that it had not given the complainant a written statement of the terms and conditions of his employment and conceded a breach of the Act. |
Findings and Conclusions:
At the start of the hearing, the respondent accepted that it had not given the complainant a written statement of the terms and conditions of his employment and conceded a breach of the Act. Therefore, I find that the complaint is well founded and order the employer to pay the employee compensation equivalent to two weeks remuneration. The complainant’s remuneration was €632.50 per week as evidenced by his payslip. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Having regard to all the written and oral evidence presented in relation to this complaint, my decision is that the complaint is well founded and that a breach of the Terms of Employment (Information) Act occurred. I hereby award the complainant compensation of €1265 which is equivalent to two weeks remuneration. |
