Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard and to present any information relevant to the dispute.
The hearing was held in the Hearing Rooms, Workplace Relations Commission (WRC), Carlow. The worker did not attend the hearing. The employer attended the hearing with a representative.
Background:
The worker made a complaint to the WRC that she was unfairly dismissed. As she did not have the required 12 months service under the Unfair Dismissals Act, the case defaulted to an industrial relations complaint. The employer at that time did not object to the case proceeding under the industrial relations process. |
Summary of Workers Case:
The worker did not attend the hearing. I am satisfied that the worker was on notice of the date and time of the hearing. |
Summary of Employer’s Case:
The employer attended along with their representative and made a submission at the beginning of the hearing. |
Conclusions:
As I am satisfied that the worker was on notice of the hearing and did not attend to outline her dispute, I recommend that her dispute with her former employer should be considered as closed.

Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
