Procedure:
In accordance with Section 41 of the Workplace Relations Act [2015-2021], following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to present any relevant evidence. In this regard, an adjudication hearing was convened in Mullingar Court House on 5/3/2024 @10am. I waited until 11.00am - however, neither party attended.
Summary of Complainant’s Case:
The Complainant submitted a Complaint Form to the WRC on 26/9/2023 in the course of which he stated that he commenced employment with the Respondent on 29/5/2023, that his employment ended on 9/6/2023 and that his complaint was being brought under the Payment of Wages Act [1991-2017] in respect of alleged monies owing to him. |

The Respondent did not provide any written submission. |
Findings and Conclusions:
A complaint was received by the Director General of the Workplace Relations Commission from the Complainant on 26 September 2023. The said complaint was referred to me for investigation. An adjudication hearing was convened in Mullingar Court House on 5 March 2024. There was no appearance by or on behalf of the Complainant at the hearing. Having checked the file I am satisfied the Complainant was properly notified by letter dated 12 January 2024 of the date, venue and time of the adjudication hearing.
In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded and I decide accordingly. |
Decision:
Section 41 of the Workplace Relations Act [2015 – 2021] requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
