Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints. All evidence is given under oath or affirmation and is subject to cross-examination.
Background:
The Complainant has been employed by the Respondent as a retail employee since 25th July 2023 and was a current employee at the time of the filing of her complaints. The Complainant alleges that her employer has breached and/or is breaching the provisions of the Terms of Employment (Information) Act, 1994, in relation to two matters, and is also in contravention of Regulation 18 of the European Communities (Road Transport) (Organisation of Working Time of Persons Performing Mobile Road Transport Activities) Regulations 2012 - S.I. No. 36/2012, in relation to her. |

Findings and Conclusions:
The complaints were received by the Director General of the Workplace Relations commission on 22nd February 2024 whereby the Complainant alleged that her employer contravened the provisions of the Terms of Employment (Information) Act, 1994, in relation to two matters, and, further, had contravened Regulation 18 of the European Communities (Road Transport)(Organisation of Working Time of Persons Performing Mobile Road Transport Activities) Regulations 2012 - S.I. No. 36/2012 in relation to her. The complaints were assigned the complaint application numbers CA-00061728-001, CA-00061728-004 and CA-00061728-005 respectively. The said complaints were referred to me for investigation. A hearing for that purpose was arranged for 26th June 2024. There was no appearance by or on behalf of the Complainant at the hearing and there was no appearance by or on behalf of the Respondent at the hearing. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
In all of the circumstances of the matter, I must conclude that the within complaints (CA-00061728-001, CA-00061728-004 and CA-00061728-005) are not well-founded and I decide accordingly. |
