Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the disputes to me by the Director General, I inquired into the disputes and gave the parties an opportunity to be heard by me and to present to me any information relevant to the disputes.
Background:
The Worker referred two disputes under the Industrial Relations Act, 1969 to the Director General of the Workplace Relations on 12 May 2023. |
Summary of Workers Case:
There was no appearance by, or on behalf of, the Worker at the adjudication hearing. I am satisfied the Worker was notified in writing of the date, time and location of the adjudication hearing to investigate the disputes. There was no application for a postponement submitted in the period preceding the hearing. |
Summary of Employer’s Case:
In circumstances where the Worker did not attend the hearing there was no requirement for a submission to be presented by the Employer’s representative. |
Conclusions:
There was no appearance by, or on behalf of, the Worker at the hearing. I am satisfied that the Worker was informed in writing of the date, time and location of the hearing to investigate the disputes. In these circumstances, I do not recommend in favour of the Worker. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I do not recommend in favour of the Worker. |
