Workplace Relations Commission Adjudication Officer: John Harraghy
Date of Hearing: 28/05/2024
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
As this is a trade dispute under Section 13 of the Industrial Relations Act, 1969 the hearing took place in private, and the parties are not named. The parties are referred to as “the Worker” and “the Employer”. Section 13(9)(c) of the Act provides that hearings shall be heard in private and accordingly, I direct that any information that might identify the parties within this recommendation should not be published.
Background:
The worker submitted 13 separate disputes under Section 13 of the Industrial Relations Act, 1969. A hearing was arranged for 28/05/2024 and the employer’s representative and a number of employees/mangers on its behalf attended the hearing. There was no appearance by or on behalf of the worker.
The employer’s representative had submitted a comprehensive submission in relation to each of the disputes submitted under the Industrial Relations Act, 1969. The employer was prepared to provide further information at the hearing.
The hearing was adjourned for a period of 45 minutes and there was no contact from the worker at that time or up to the date of this decision. |
Summary of Workers Case:
There was no appearance by or on behalf of the worker at the hearing to pursue these disputes and provide any information or details in relation to these disputes |
Summary of Employer’s Case:
The employer’s representative and a number of employees/managers attended the hearing and were prepared to respond to these disputes and to provide further/additional information at the hearing. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
As there was no appearance by or on behalf of the worker at the hearing to pursue these disputes and provide any information or details in relation to these disputes, I conclude that I am unable to make any recommendation in favour of the worker in relation to these disputes. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the disputes outlined above.
I do not make any recommendation(s) in favour of the worker in relation to any of these 13 disputes.
