Workplace Relations Commission Adjudication Officer: Breiffni O'Neill
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 79 of the Employment Equality Acts, 1998 – 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Although the Complainant attended the remote hearing on 9 March 2023, she had not properly particularised her complaints or provided any written submission in advance of the hearing. Accordingly, I decided to adjourn the matter, with the consent of the Respondent, and requested that details of her various complaints be provided in advance of the next hearing to allow the Respondent to prepare a defence.
No further particulars were received from the Complainant after the remote hearing. Although a face-to-face hearing was convened for 15 September 2023, the Complainant did not attend and did not seek a postponement in advance.
