Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015, and Section 13 of the Industrial Relations Acts 1969 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints. As there is a dispute under the Industrial Relations Act which under that legislation is required to be anonymised, I have exercised my discretion to anonymise the parties to this complaint.

Findings and Conclusions:
As part of my investigation, I am obliged to hold a hearing. I am satisfied that both parties were notified of the arrangements for the hearing. I find that the complainant failed to attend the hearing. In the circumstances, I conclude the investigation and find against the complainant. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
Based on the circumstances outlined above and in the absence of any evidence to the contrary having been adduced before me, I conclude that the within complaint is not well-founded. |
