Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 – 2015 and Section 79 of the Employment Equality Acts, 1998 - 2015,following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Respondent attended with a number of witnesses. Submissions were received on two occasions in December 2023 and again in March 2024 from the Respondent.
The Complainant did not appear and did not submit any submissions or respond to correspondence. |
Summary of Complainant’s Case:
There was no appearance by or on behalf of the Complainant. |
Summary of Respondent’s Case:
The Respondent denied both complaints. |
Findings and Conclusions:
Having waited for a reasonable period, there was no appearance by the Complainant at the hearing. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I find the Complainant was not unfairly dismissed. I find the Complainant was not discriminated against by the Respondent. |
