Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 25 of the Equal Status Act, 2000, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

The Complainant brought equal status complaints against the Respondent Garda and several other parties. |

Findings and Conclusions:
I am satisfied that both parties were notified of the hearing and that neither attended. The Respondent’s representatives sent a letter before the hearing arguing the WRC does not have jurisdiction over this case. The Complainant was notified of the hearing at an email address he had used previously to correspond with the WRC and was contained on his complaint form. He was explicitly told by email on the 4th of March that the hearing was going ahead after he had responded to a letter from the Respondent’s solicitor. He did not attend the hearing. In the circumstances the complaint cannot succeed. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
The complaint is not well founded. |
