Complaint seeking adjudication by the Workplace Relations Commission under Section 21 Equal Status Act, 2000 | CA-00060323-001 | 19/09/2023 |
Date of Adjudication Hearing: 12/03/2024
Workplace Relations Commission Adjudication Officer: David James Murphy
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 25 of the Equal Status Act, 2000 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant submitted complaints against the Respondent Garda. A hearing was scheduled for the 12th of March 2024. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing. |
Findings and Conclusions:
I am satisfied that both parties were notified of the hearing and that neither attended. Garda Buggy emailed respectfully declining to attend on the basis that she believed that this matter was not properly within the jurisdiction of the WRC. The Complainant was notified of the hearing at an email address he had used previously to correspond with the WRC and was contained on his complaint form. He did not attend the hearing. In the circumstances the complaint cannot succeed. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
The complaint is not well founded. |
