Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

This complaint is for unpaid wages which accrued prior to the end of the Complainant’s employment.

There was no appearance by or on behalf of the Complainant at Adjudication Hearing on 25 March 2024

There was no appearance by or on behalf of the Respondent at Adjudication Hearing on 25 March 2024

Findings and Conclusions:

The parties were put on notice by the WRC, by letter dated 1 March 2024, that the Adjudication hearing would take place on 25 March 2024. No application for an adjournment was received by the WRC prior to the hearing date. As neither party attended the hearing, and as the onus of proof is on the Complainant to discharge, I find that there is no evidential basis upon which this complaint may be determined to be well founded.

Finding:

This complaint is not well founded.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
