Complaint seeking adjudication by the Workplace Relations Commission under Section 13 of the Industrial Relations Act | CA-00059500-001 | 19/10/2023 |
Date of Adjudication Hearing: 13th Feb 2024
Workplace Relations Commission Adjudication Officer: Hugh Lonsdale
Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969, following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
A hearing of this dispute was scheduled for 13 February 2024. Both parties were informed by latter dated 9 January 2024. The worker did not attend the hearing but gave no reason for not attending the hearing. The employer did attend the hearing. |
Summary of Complainant’s Case:
The worker did not attend the hearing. |
Summary of Respondent’s Case:
The employer attended the hearing and was prepared to put forward its position in relation to the dispute. |
Findings and Conclusions:
The dispute was referred to me to inquire into. A hearing for that purpose was scheduled for 13 February 2024. There was no appearance by the worker. I am satisfied the worker was informed in writing of the date, time and place of the hearing. In these circumstances and in the absence of the worker to put forward his position in relation to the dispute he raised I conclude that I am unable to make a recommendation. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
As the worker was not present to put forward his position in relation to the dispute he raised I find that I am unable to make a recommendation. |
