| 04/06/2020 |
Workplace Relations Commission Adjudication Officer: Louise Boyle
Date of Hearing: 17/02/2023 & 06/10/2023
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The worker submitted on his complaint form that there were no procedures in place for bullying and harassment and that he suffered from bullying. |
Summary of Workers Case:
At the hearing on 17/02/2023 the hearing was adjourned to allow both the employer and worker to submit further information. At the hearing of 06/10/2023 the worker did not attend the hearing to advance his dispute.
I note the complaint form says there were no procedures in place for bullying and harassment and that the worker suffered from bullying. |
Summary of Employer’s Case:
At the hearing on 17/02/2023 the hearing was adjourned to allow both the employer and worker to submit further information. At the hearing of 06/10/2023 the worker did not attend the hearing to advance his dispute.
The employer attended and the employer denied the claims. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
A complaint was received by the Director General of the Workplace Relations Commission from the worker on 04/06/2020. The said dispute was referred to me for investigation. A hearing for that purpose was held on 17/02/2023 and parties were advised to submit further information. Another hearing was scheduled for 06/10/2023 and there was no appearance by the worker. I am satisfied that the said worker was informed in writing of the date, time and place at which the hearing to investigate the complaint would be held and did not attend.
The worker submits that there were no procedures in place for bullying and harassment and that the worker suffered from bullying. The employer denies the dispute and the worker did not attend to advance his dispute.
Taking into consideration the worker failed to attend to advance his dispute I do not find merit in the worker’s dispute. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
Taking into consideration the worker failed to attend to advance his dispute I do not find merit in the worker’s dispute. |
