Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant was employed as a chef with the respondent from 07/11/2019 until 21/08/2023. He was paid €200.00 per week and worked 16 hours each week. The complainant submits that he was discriminated against by reason of his family status, conditions of employment and that he was victimized. He alleges that the discrimination occurred when he complained about a colleague, and he was then told without explanation that he was no longer required to work. He also submits that he was not paid any Sunday allowance and that the respondent showed no respect for him.
There was no submission received on behalf of the respondent.
A hearing was arranged for 16/05/2024 in Lansdowne House and there was no appearance by or on behalf of the complainant or the respondent. There was no notification or communication received from either party in relation to their nonattendance up to the date of this decision. |

Findings and Conclusions:
I am satisfied that the complainant was properly notified of the date, time and venue of the hearing. As there was no appearance by or on behalf of the complainant at the hearing to pursue his complaint and/or give evidence in relation to this complaint I conclude that this complaint is not well founded. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
As there was no appearance by or on behalf of the complainant at the hearing to pursue the complaint and/or give evidence in relation to these complaint I conclude that this complaint is not well founded. |
