Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant was employed by the respondent as a Chef de Partie. Employment commenced on 5th December 2022 and ended on 26th September 2023. This complaint was received by the Workplace Relations Commission on 1st December 2023. |
Summary of Complainant’s Case:
On 17th September 2023 the complainant received his wage slip showing a nett payment of € 1271.68. Paid into his bank account for the same period was €500. The complainant’s wages for this period were €771.68 short of what should have been paid to him. The Complainant made several attempts to obtain this amount from the Respondent. |
Summary of Respondent’s Case:
The Respondent did not attend the scheduled hearing of the complaint. By letter dated 21st March 2024 the respondent was advised of the hearing arrangements i.e., date, time and venue etc. |
Findings and Conclusions:
At the hearing the complainant presented his case in an honest and open fashion. I find the complaint to be well founded and now order the respondent to pay the sum of €771.68 to the complainant within 42 days of the date of this decision. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
