Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The complaint is that the Respondent failed to pay the Complainant wages due for the last 5 weeks of his employment.

Summary of Complainant’s Case:

The Complainant confirmed that his complaint, submitted on 17th December 2023 was in respect for his final month’s salary which amounted to the net sum of €2460.70 plus a net sum of €492.14 which had not been paid to him as his due wages on cessation of his employment on 6th October 2023.  He had been employed by the Respondent since 27th June 2016.

Summary of Respondent’s Case:

The Respondent was notified of the date, time and platform for the hearing but did not attend.

Findings and Conclusions:

Based on the uncontested submission of the Complainant, I find his complaint to be well founded.     I require the Respondent to pay to the Complainant the net sum of €2,952.84 within six weeks of the date of this decision.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint  in accordance with the relevant redress provisions under Schedule 6 of that Act.

 I have decided that the complaint is well founded, and I require the Respondent to pay to the Complainant the net sum of €2,952.84 within six weeks of the date of this decision.
