Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint. The hearing was held in the Hearing Rooms of the Workplace Relations Commission (WRC), Carlow. The complainant attended the hearing and gave evidence under oath. The respondent did not attend the hearing.
Background:
The complainant was employed as a Tiler for the respondent from 29th January 2024 to 6th February 2024. He sought payment from the respondent after completing his first week’s work. When no payment was forthcoming, he referred the complaint to the WRC. |
Summary of Complainant’s Case:
The complainant gave evidence that he worked 4 days with the respondent. On his last day, he was picked up by the respondent at 7.15am to attend a job. As there was no work that morning, he was dropped off at 10.15am. He gave evidence that he sought payment on a few occasions from the respondent for the work carried. He said that he was owed €420 for the work he carried out. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. I waited fifteen minutes before commencing the hearing in case the respondent was running late. I am satisfied that the respondent was on notice of the hearing. |
Findings and Conclusions:
Based on the uncontested evidence, I decide that the complaint is well founded. I find that there has been a breach of the Payment of Wages Act in that the complainant was not paid wages properly payable having completed four days and three hours work. I find that the complaint is well founded and that a payment of €420 is properly due by the respondent to the complainant. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
CA 00061620- I find that the complaint pursuant to the Payment of Wages Act, 1991 is well founded and the respondent shall pay the complainant compensation of €420 for outstanding wages. |
