Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The Worker was employed by the Employer for 4 years until his resignation. He submitted this trade dispute alongside a number of statutory complaints. |
Summary of Workers Case:
The Worker advanced a number of statutory complaints alongside this trade dispute. He never sought any particular recommendation related to this trade dispute. |
Summary of Employer’s Case:
The Employer denies any wrongdoing and was of the view that the Worker failed to particularise any trade dispute to be investigated. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
I am in agreement with the Employer. There was no clearly defined trade dispute highlighted to me in the course of the hearing nor any specific recommendation sought by the Worker. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I recommend that no further action be taken.
