Workplace Relations Commission Adjudication Officer: Roger McGrath
Date of Hearing: 30/01/2024
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
IR - SC - 00001226
AND
IR - SC - 00001227
Background:
The two complaints made under this Act are identical to complaints made under two other Acts. The complaints were investigated by an adjudication officer and findings were made under the other two Acts. The adjudication officer issued two Decisions under each of the other two Acts. |
Summary of Workers Case:
The worker submits that she was subject to humiliation, degradation, bullying and intimidation at the hands of her employer, particularly by one manager and the employer did not do as much as it should have to address these matters. |
Summary of Employer’s Case:
The employer submits that it did everything it could to address the concerns raised by the worker. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
The subject matter of these two IR complaints have been fully ventilated and were subject of an adjudication officer’s investigation elsewhere. Two Decisions have been issued on them. That being the case I do not believe it would serve any purpose to do other than refer the worker and employer to those two Decisions and recommend they be accepted by both. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I recommend the worker and the employer accept the two Decisions issued on the complaints made.
