Referral in accordance Section 20(1) Industrial Relations Act, 1969.
BACKGROUND:
This dispute concerns a complaint in relation to treatment by the company. The Worker referred this case to the Labour Court on 12 January 2024 in accordance with Section 20 (1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court’s Recommendation. A Labour Court hearing took place on 12 April 2024.
RECOMMENDATION:
Background to the Dispute
The Worker was employed by Reads Design & Print (‘the Company) as a Large Format Printer between 29 November 2023 and 12 January 2024. In the words of the Company’s Representative, “an ill-tempered exchange” took place on the latter date between the Worker and her line manager, as a consequence of which the Worker’s employment came to an end.
The Worker submits that her employment was terminated “without reason” by her line manager. It is submitted on the Company’s behalf that the Worker resigned her employment by leaving the office when the line manager had said to her “You can leave if you want”. In response to questions from the Court enquiring as to whether the line manage had made any attempt to follow up with the Worker after the events of 12 January 2024, the Court was informed that nobody from the Company had attempted to contact the Worker to discuss the situation.
Discussion and Recommendation
Having considered both Parties’ written and verbal submissions, the Court finds that the Worker was summarily dismissed by her line manager on 12 January 2024. The line manager failed to observe even the minimum of fair procedures in effecting the Worker’s dismissal.
The Court recommends that the Worker receive €3,000.00 for the unfair manner in which she was dismissed from her employment.
The Court so recommends.
