Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 39 of the Redundancy Payments Acts 1967 - 2014following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

There was no appearance by either party at today’s hearing.

Summary of Complainant’s Case:
There was no appearance for or on behalf of the Complainant at today’s hearing. The hearing notice was sent to the Complainant on the 4th October 2024. The Complainant sent an email to the WRC on 28th November at 4.20am stating “Good Morning Isabelle, Apologies, but I am currently in Marrakech on holidays and won't be back until Sunday 1st December. I am actually surprised at the appointment as I was under the impression the adjudication made, the last time, was final. I wasn't expecting a follow up hearing or meeting. Kind regards, Julie Hogan”.

Findings and Conclusions:
There was no appearance for or on behalf of the Complainant at today’s hearing. The hearing notice was sent to the Complainant on 4th October 2024. The Complainant sent an email to the WRC on 28th November at 4.20am stating “Good Morning Isabelle, Apologies, but I am currently in Marrakech on holidays and won't be back until Sunday 1st December. Based on the email I am satisfied that the Complainant was on notice of the hearing today and as she was not granted a postponement it was incumbent on her to attend the hearing today to apply for an adjournment. As the hearing was a remote hearing she could have attended remotely to apply for the adjournment. She did not. In those circumstances I have no option but to find that the complaints are not well founded and according fail. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
