Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed by the Respondent since 12 July 2021.

Summary of Complainant’s Case:
The Complainant was employed with the company and was not paid three weeks wages. She received payslips for 16th and 23rd February 2023 and 2nd March 2023 but no pay. The Complainant provided copies of the payslips and bank statements to verify non-payment. She couldn’t afford to stay working with the company as she was not being paid and left. There were cashflow problems. |
Summary of Respondent’s Case:
There was no appearance by or on behalf of the Respondent. |
Findings and Conclusions:
I heard and considered the evidence and submissions of the Complainant. The Complainant was employed from 12th July 2021 as an office administrator on a weekly wage of 615.88 euro. Due to cashflow problems she was not paid her weekly wages of 615.88 gross and holidays for 16th, 23rd February 2023 and 2nd March 2023 total 2,065.26 in breach of S 5 of the Act. I find the complaint is well founded and direct payment of 2,065.26 euro gross wages owed by the Respondent together with compensation of net 588.02 euro to the Complainant. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is well founded and direct payment of 2,065.26 euro gross wages owed by the Respondent together with compensation of net 588.02 euro to the Complainant. |
