Workplace Relations Commission Adjudication Officer: Hugh Lonsdale
Procedure:
In accordance with Section 25 of the Equal Status Act, 2000, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
A hearing of this complaint was scheduled for 14 October 2024 and both parties were informed of this by letter dated 29 August 2024, which was sent by email. The complainant did not attend the hearing. No communication was given by the complainant for his non-attendance. The respondent did attend the hearing. |
Summary of Complainant’s Case:
The complainant did not attend the hearing. |
Summary of Respondent’s Case:
The respondent did attend the hearing and was prepared to put forward its position in relation to the complaint. |
Findings and Conclusions:
The complaint was referred to me for investigation under the Equal Status Act. A hearing for that purpose was scheduled for 14 October 2024. The complainant did not attend the hearing. I am satisfied the complainant was informed in writing of the date, time and place of the hearing. He gave no reason for not attending. In the circumstances I conclude that the complainant is unable to demonstrate that he was discriminated against by the respondent. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
The complainant did not attend the hearing and is unable to demonstrate that he was discriminated against by the respondent. |
