Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015, and Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The WRC received two complaints from the Complainant on the 11th of December 2023 under Section 8 of the Unfair Dismissals Act, 1977 and section 77 of the Employment Equality Act, 1998 25/10/2023 .
The day before the hearing the complainant’s representative contacted the WRC advising that settlement negotiations were underway and requested a change in the format of the hearing. This request was refused and the parties were advised that the hearing was proceeding as scheduled.
On the day of the hearing the Adjudicator was present at the hearing venue at the scheduled time and neither the complainant nor the respondent attended the hearing. |

Findings and Conclusions:
I am satisfied that the Complainant was notified of the date, time, and place of the hearing. I note that the complainant’s representative requested a change in the format of the hearing the evening before the scheduled hearing and that this request was refused. I also note that the parties were advised that the hearing was proceeding as scheduled. In these circumstances I find against the Complainant as no case was presented by her and no evidence moved in support of her case. The Respondent was not in attendance. I declare that the complaints under Section 6 of the Payment of Wages Act 1991 and under Section 7 of the Terms of Employment Act 1994 are not well founded. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I declare this claim to be not well founded. |
