Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Respondent was represented at the hearing with submissions received in advance of the first haring date. Ms. Helena Hammond, Manager appeared to give evidence on behalf the Respondent.

Summary of Complainant’s Case:

After waiting a reasonable period of time , there was no appearance by the Complainant at the hearing.

The first hearing on 27 August 2024 was adjourned to give Complainant a fair opportunity to appear in particular circumstances. Efforts were made to contact the Complainant via the contact details he provided on his Complaint Form.

Summary of Respondent’s Case:

The Respondent noted the correct name of the employer. The correct name of the Respondent is Coral Leisure Killarney Limited.

The Respondent denied the Complainant’s complaint in its entirety.

Findings and Conclusions:

In the circumstances where there was no appearance by the Complainant, I find there was no contravention of the Act.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

I find there was no contravention of the Act.
