Complaint seeking adjudication by the Workplace Relations Commission under section 13 of the Industrial Relations Act, 1969 | CA-00063415-001 | 12/05/2024 |
Workplace Relations Commission Adjudication Officer: Louise Boyle
Date of Hearing: 30/09/2024
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute. The hearing was heard remotely, pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. 359/2020, which designated the Workplace Relations Commission as a body empowered to hold remote hearings.
Background:
The worker did not attend the hearing. The worker submitted that he was dismissed unfairly without notice. |
Summary of Workers Case:
The worker did not attend the hearing.
In their claim form the worker submits that they were dismissed without notice and without procedures and may be owed annual leave. |
Summary of Employer’s Case:
The employer denies the claims. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
A dispute was received by the Director General of the Workplace Relations Commission from the worker on 12/05/2024 alleging contravention of the Act. The said dispute was referred to me for investigation. A hearing for that purpose was held on 30/09/2024 and there was no appearance by the worker. The employer attended the hearing and refuted the claims. I am satisfied that the said worker was informed in writing of the date, time and place at which the hearing to investigate the dispute would be held and did not attend.
I find that this dispute is not well founded and dismiss the dispute. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I find that this dispute is not well founded and dismiss the dispute. |
