Procedure:

In accordance with Section 41 of the Workplace Relations Act and Section 6 of the Payment of Wages Act, 1991 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The issues in contention concerned alleged unpaid wages, holiday pay, notice pay, and an unfair dismissal payment claimed by a Floor Manager against a Restaurant/Hospitality venue.

The employment began on the 17th October 2022 and ended on the 1st of July 2024. The Restaurant did not open for business after that date.

The gross pay was €744.75 per week for 42.60-hour week.

1: Non-appearance of Parties.

An Oral Hearing had been arranged for the 18th October 2024.

All Parties were fully notified of the time date and place of the Hearing.

A period of time was allowed post the Hearing for communications from either party offering explanations for non-appearance. Nothing was received.

Accordingly, in the absence of any Oral or Written evidence the Complaint is deemed legally Not well Founded and is dismissed.

2: Decision:

Section 41 of the Workplace Relations Act 2015and Section 6 of the Payment of Wages Act, 1991requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions of the cited Acts.

The Complaint is dismissed, in the absence of any evidence, as Legally Not Well Founded.

The Complaint fails.
