Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submitted a Complaint Form which was received by the Workplace Relations Commission 8 July 2024. Submissions were received from the Complainant in advance of hearing.
Ms. Catherine Murphy, an employee, attended on behalf of the Respondent. |
Summary of Complainant’s Case:
The Complainant stated he was unable to attend at hearing. He was clearly advised as to the Postponement Procedure and provided with all relevant information. No further correspondence from the Complainant was received. There was no appearance by the Complainant after waiting a reasonable period. |
Summary of Respondent’s Case:
A Director of the Respondent applied for a postponement but was refused. At the hearing , an employee appeared and made a further application for a postponement. |
Findings and Conclusions:
In circumstances where the Complainant did not attend the hearing to prosecute his complaint, I find that the same is not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the complaint is not well-founded. |
