Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute. The hearing was heard remotely, pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. 359/2020, which designated the Workplace Relations Commission as a body empowered to hold remote hearings.
Background:
The worker did not attend the hearing. The worker submitted that they were dismissed unfairly and there were breaches of GDPR. |

The worker submitted on their form that they were dismissed unfairly and that the employer made disclosures about their employment to somebody without their permission to do so and that their position was advertised again. The worker did not attend the hearing. |

Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
A dispute was received by the Director General of the Workplace Relations Commission from the worker on 30/05/2024 alleging contravention of the Act. The said dispute was referred to me for investigation. A hearing for that purpose was held on 30/09/2024 and there was no appearance by the worker. The employer attended the hearing and refuted the claims. I am satisfied that the said worker was informed in writing of the date, time and place at which the hearing to investigate the dispute would be held and did not attend.
I find that this dispute is not well founded and dismiss the dispute. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
