Appeal of Adjudication Officer Decision No's: ADJ-00047278 (CA-00058328-002)
BACKGROUND:
The Employer appealed the Decision of the Adjudication Officer to the Labour Court on the 9th October 2023 in accordance with Section 8 (1) of the Terms of Employment (Information) Acts, 1994 to 2012. A Labour Court hearing took place on the 19th September 2024.
The following is the Decision of the Court.
DECISION:
This matter comes before the Court as an appeal by Easy Meals Limited (the Appellant) of a decision of an Adjudication Officer made under the Terms of Employment (Information) Act, 1994 (the Act) in the complaint of Stacey Barrett (the Complainant).
The Adjudication Officer decided that the complaint of the Complainant was well founded.
The hearing of the Court
The Court is satisfied that both parties were properly notified of the date, time and venue for the hearing of the Court.
The Complainant attended the hearing of the Court, and the Appellant did not attend the hearing. The Court delayed the commencement of its hearing on the day, but notwithstanding this accommodation the Appellant did not attend the hearing.
The Appellant not being present to move its appeal, the within appeal failed.
Decision
The within appeal fails and the decision of the Adjudication Officer is affirmed.
The Court so decides.
