Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
Background:
Two complaints were received by the Workplace Relations Commission on 16th May 2023. Both complaints were received under section 13 of the Industrial Relations, 1969. |
Summary of Workers Case:
The Complainant did not attend the scheduled hearing of the complaints. |
Summary of Employer’s Case:
The Respondent did attend the scheduled hearing and was in a position to present a defence. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
IR – SC - 00001657 As part of my investigation under section, I am obliged to hold a hearing. I am satisfied that the Complainant was notified of the arrangements for the hearing. I find that the complainant’s failure to attend such a hearing was unreasonable in the circumstances. As no evidence was given at the hearing in support of the allegations of the complaint, I conclude the investigation and find against the complainant. IR – SC - 00001658 As part of my investigation under section, I am obliged to hold a hearing. I am satisfied that the Complainant was notified of the arrangements for the hearing. Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
