Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The hearing was held online. Unfortunately, and somewhat unusually there were technical problems with the Webex log in link and in getting the hearing underway. It was delayed for about an hour. In due course, new log in links were issued to the parties and the complainant failed to log in. Initially, there was a possibility that the complainant may have logged in on the earlier, unsuccessful link and therefore may have been initially in attendance but could not then log in the second time. For that reason, the hearing was adjourned with a view to being re-scheduled. It was subsequently established that by the WRC Case Officer, that despite being sent the log in details prior to the hearing the complainant had, in fact failed to log in to attend the hearing and present his case, or provide any acceptable explanation as to why he had failed to do so. |

Findings and Conclusions:
A complaint was received by the Director General of the Workplace Relations Commission by the complainant alleging breaches of the above statutes and was referred to me for investigation. There was no appearance by, or on behalf of, the complainant at the hearing. I am satisfied that the complainant consented to receiving correspondence by email and was sent notice in writing to the address provided on the complaint form of the date, time and place at which the hearing to investigate the complaint would be held. In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaints are not well-founded and I decide accordingly. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
For the reasons set out above Complaint CA-00067758-001 is not upheld. |
