Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant is owed monies for hours worked that to date have not been paid. The Respondent company is in liquidation.

Summary of Complainant’s Case:
The Complainant commenced working for the Respondent on 20 June 2011. The Respondent company went into liquidation on 11 June 2025. On that date the Complainant was owed wages in the amount of € 5,445.00. The net payments due are broken down as follows: 15.11.2024 - € 250.00 22.11.2024 - € 874.58 29.11.2204 - € 987.42 06.12.2024 - € 271.84 03.01.2025 - €782.61 10.01.2025 - €782.60 21.02.2025 - € 400.00 07.03.2025 - € 48.84 ( includes 14.03.2025 having deducted an overpayment) 28.03.2025 - € 314.47 04.04.2025 – 802.65 11.04.2025 – €770.00 The Complainant made attempts to recoup the monies owed from his Employer and from the Liquidator but to date those attempts have been unsuccessful. |
Summary of Respondent’s Case:
There was no appearance for or on behalf of the Respondent. The liquidator has been in contact with the WRC and did make attempts to secure the attendance of the company directors however, they declined to attend. |
Findings and Conclusions:
There was no appearance for or on behalf of the Respondent. I am satisfied based on the communications between the liquidator and the WRC and on the information contained in the case file that the liquidator was on notice of the date time and venue for the hearing today. The Complainant brings a claim pursuant to Section 6 of the Payment of Wages Act for wages due and owing to him by the Respondent company. Evidence was given in conjunction with supporting documentation, that the following net payments remain due and owing: 15.11.2024 - € 250.00 22.11.2024 - € 874.58 29.11.2204 - € 987.42 06.12.2024 - € 271.84 03.01.2025 - €782.61 10.01.2025 - €782.60 21.02.2025 - € 400.00 07.03.2025 - € 48.84 ( includes 14.03.2025 having deducted an overpayment) 28.03.2025 - € 314.47 04.04.2025 – 802.65 11.04.2025 – €770.00 The total amount due is € 5,445.00 net. In all the circumstances I find that the complaint is well founded. I award the Complainant €5,445.00

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
