Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submitted a complaint under the Sick Leave Act 2022 for period of sick leave in the summer of 2023. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing. |
Summary of Respondent’s Case:
The Respondent attended the hearing and made detailed written submissions ahead of the hearing. They submit that they had done their upmost to support the Complainant while managing what a difficult and complex situation regarding the Complainant’s illness. At the time of his illness he was not entitled to statutory sick pay. |
Findings and Conclusions:
The Complainant did not attend the hearing. On review of the WRC’s file, it is clear that the Complainant was notified of the hearing at the email address he supplied to the WRC when he submitted his complaint. In the circumstances the complaint must fail. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the complaint is not well founded. |
