Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant brings claims for outstanding wages and holiday pay arising from the closure of Metron Stores Limited. Neither the Liquidator nor the Complainant attended at the scheduled hearing. I am satisfied that the Complainant’s representative was notified of the date, time and location of the hearing and failed to attend. |
Summary of Complainant’s Case:
The Complainant and his representative on record failed to attend at the hearing to make out his case. In these circumstances I must find that the complaints cannot succeed for failure to attend. |

The Respondent failed to attend. |
Findings and Conclusions:
The Complainant failed to attend at the hearing. I am satisfied that the Representative on record was notified of the date, time and place of the hearing. In these circumstances I must find that the complaints are not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complainant failed to attend. I must determine arising from his non-attendance to present his case that his claim for outstanding wages and holiday pay are not well founded. |
