Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015, Section 8 of the Unfair Dismissals Acts, 1977 – 2015 and Section 79 of the Employment Equality Acts, 1998 - 2015,following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Although I am satisfied that the Complainant was on notice of the time and date of the hearing, she did not attend the hearing on the day to give evidence.
Background:
The Complainant was employed as a Teacher by the Respondent from 29 August 2022 to 19 October 2023. On 18 April 2024, she submitted a number of complaints to the WRC in relation to her employment. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing on the day to give evidence in relation to her complaints. |
Summary of Respondent’s Case:
As the Complainant did not attend the hearing on the day to give evidence in relation to her complaints, the Respondent did not present any evidence. |
Findings and Conclusions:
As the Complainant did not attend the hearing on the day to give evidence in relation to her complaints, I find that the complaints are not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
CA-00062894-001 - CA-00062894-003: As the Complainant did not attend the hearing on the day to give evidence in relation to her complaints, I find that the complaints are not well founded. CA-00062894-004: As the Complainant did not attend the hearing on the day to give evidence in relation to her complaint, I find that she failed to establish a prima facie case of discrimination. |
