Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015,following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Although I am satisfied that the Complainant was on notice of the time and date of the hearing, he did not attend the hearing on the day to give evidence.
Background:
The Complainant was employed as a Factory Operative by the Respondent from 31 October 2022 to 13 October 2023. He submitted a number of complaints to the WRC in relation to his employment on 10 May 2024. |
Summary of Complainant’s Case:
The Complainant did not attend on the day of the hearing on the day to give evidence in relation to his complaints. |
Summary of Respondent’s Case:
As the Complainant did not attend on the day of the hearing on the day to give evidence in relation to his complaints, the Respondent did not present any evidence. |
Findings and Conclusions:
As the Complainant did not attend the hearing on the day to give evidence in relation to his complaints, I find that the complaints are not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I find that the complaints are not well founded for the reasons set out above. |
