Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submitted a complaint for discrimination on the grounds of failure to provide reasonable accommodation for her disability, victimization and other against her employer with the most recent date of discrimination being 24 June 2024. |
Summary of Complainant’s Case:
There was no appearance by the Complainant. She was phoned by the Workplace Relations Commission on the date of the hearing and advised she was not going to attend the hearing. I am satisfied the Complainant was on notice of the hearing. After waiting a reasonable period of time, the hearing was opened. |
Summary of Respondent’s Case:
The Respondent filed detailed submissions in advance of the hearing. The Respondent attended with four witnesses to dispute the complaint. |
Findings and Conclusions:
In the circumstances where the Complainant chose not to attend the hearing to give evidence in her own complaint, it is found that she was not discriminated against by the Respondent. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I found the Complainant was not discriminated against by the Respondent. |
