Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint. The hearing was heard remotely, pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. 359/2020 which designated the WRC as a body empowered to hold remote hearings. Witnesses were sworn in at the commencement of the hearing.
Summary of Complainant’s Case:
The complainant commenced employment with the respondent on 10 October 2022. He worked as a cabinet maker for the company. The complainant states that his employment ended with the respondent on 13 August 2024. The complainant states that he is owed over 3 weeks pay in respect of his final weeks working with the company. He states that the respondent is in breach of the Payment of Wages Act. The complainant states that he is owed €1950 in wages. |
Summary of Respondent’s Case:
The respondent accepted that the complainant is due €1950 in wages; however it was submitted that the company is in a lot of debt and did not have the funds available to pay the complainant but they would endeavour to pay the complainant his wages due over the coming weeks. |
Findings and Conclusions:
Having heard the evidence on the within matter, I find that the complaint is well-founded and the respondent is in breach of the Payment of Wages Act. I order that the respondent pay the complainant his wages due in the amount of €1950. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the within complaint is well-founded and the respondent is in breach of the Payment of Wages Act. I order that the respondent pay the complainant his wages due in the amount of €1950. |
