Procedure:
In accordance with section 41 of the Workplace Relations Act 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant referred a complaint under section 24 of the National Minimum Wage Act 2000 to the Workplace Relations Commission.
By correspondence dated 3 December 2024, the Commission notified the parties of the hearing arrangements for 14 January 2025. There was no attendance by either party at the hearing. |
Findings and Conclusions:
The Commission notified the complainant of the hearing arrangements in accordance with the contact information provided. The Commission notified the respondent of the same arrangements at its registered address. Accordingly, I am satisfied that the parties were properly notified of the hearing arrangements for this complaint.
There was no contact by either party with the Commission in relation to the hearing arrangements and no explanation provided for non-attendance at the hearing.
I note also that neither party was in contact with the Commission subsequent to the referral / notification of the complainant’s complaint. A query raised by the Commission following a validation check on the complaint form was not responded to by the complainant.
It was necessary for the complainant to attend the hearing in pursuit of their complaint.
In the circumstances, I must conclude that the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons set out above, I find that this complaint is not well founded. |
