Complaint seeking adjudication by the Workplace Relations Commission under section 27 of the Organisation of Working Time Act, 1997 | CA-00067382-002 | 14/11/2024 |
Date of Adjudication Hearing: 11/02/2025
Workplace Relations Commission Adjudication Officer: Pat Brady
Procedure:
In accordance with Section 41 of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant did not attend the hearing. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. |
Findings and Conclusions:
The complainant was employed by the respondent from September 3rd, 2024, until October 3rd 2024. His complaint was that he was required to work more than the maximum permitted number of hours on occasions when staff were short and work numerous forty-eight hour shifts.
By Email November 15th, 2024, he advised the WRC that the named respondent, while being the main contractor was not the correct object of his complaint.
However, he has subsequently failed to provide details of the correct respondent.
In the event neither he, nor the respondent attended the hearing
In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded and I decide accordingly. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons set out above, complaint CA-00067382-002 is not well founded. |
