Complaint seeking adjudication by the Workplace Relations Commission under section 77 of the Employment Equality Act 1998 | CA-00067956-001 | 09/12/2024 |
Date of Adjudication Hearing: 18/02/2025
Workplace Relations Commission Adjudication Officer: Kara Turner
Procedure:
In accordance with section 79 of the Employment Equality Acts 1998 - 2015,following the referral of the case to me by the Director General, I inquired into the case and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the claims.
Background:
The complainant referred a case under section 77 of the Employment Equality Acts 1998-2015 to the Workplace Relations Commission.
There was no attendance by either party at the hearing arranged by the Commission.
|
Findings and Conclusions:
By correspondence dated 27 January 2025, the Commission notified the parties of the hearing arrangements for 18 February 2025.
Further to the complainant’s communication of 28 January 2025, the parties were informed of hybrid hearing arrangements for 18 February 2025. Neither party attended the hearing on 18 February and there was no explanation provided for non-attendance. In circumstances where it was necessary for the complainant to attend the hearing in pursuit of their case, I must conclude that the claims against the respondent are not well founded. |
Decision:
Section 79 of the Employment Equality Acts 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Acts.
For the reasons set out above, my decision is that the claims are not well founded and that there was no contravention of the Employment Equality Acts. |
